Land enquiry checklist: location, access, use and documents

When looking at land, first establish the lot's location, boundaries, access and your intended use. An arrangement that looks usable on site does not necessarily mean the corresponding right or approval exists; important matters must be checked against documents and by a suitable professional.

How do you check location and boundaries?

Ask for clear lot particulars and a location plan, and on site identify the boundaries, the neighbouring land and the current use. Do not take a fence or objects placed there as the lot boundary. Where you need a precise area or boundary, arrange for a suitable professional to verify it.

  • Keep the lot particulars, site photos and location plan.
  • Record whether there are slopes, watercourses, structures or other installations.
  • Ask about the current occupier and the handover arrangements.

Does a road to the site mean there is lawful access?

Being able to get there in practice does not mean there is a right to use that access. Find out who manages the access, whether it crosses neighbouring land, whether vehicles can get in and out, and who is responsible for maintenance. For utilities such as water and electricity, also confirm the source, connection conditions and cost.

What checks does the intended use need?

State clearly whether the use is agriculture, storage, parking, building or something else, then check the relevant land lease, planning and approval documents. Do not treat the words 'can be used for' in a listing as an approval. Before signing or paying any money, obtain suitable legal or professional advice on use, rights and restrictions.

If the land is currently used in a certain way, can I keep using it that way afterwards?

You cannot judge from the site alone. Check the lot documents, the relevant approvals and the restrictions that apply, and confirm whether your intended use is feasible.
